Terms of Service

1. Acceptance of Terms

By downloading, installing, or using AckerTech Optimizer (“the Software”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software. You must be at least 13 years of age (or 16 in the European Economic Area) to use the Software. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

2. License Grant

AckerTech grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for personal, non-commercial use only, subject to these terms.

  • Free version: Single device only
  • Premium: Up to 3 active devices simultaneously. Devices can be deactivated and reactivated through your account
  • Licenses are non-transferable and cannot be sold, gifted, or shared. Attempting to do so will result in immediate licence revocation
  • Commercial use requires a separate business licence. Contact admin@ackertech.net for enquiries
  • Free features are perpetual. Premium subscriptions are valid for the purchased period only

3. Restrictions

You agree not to:

  • Reverse engineer, decompile, or disassemble the Software
  • Modify, adapt, or create derivative works based on the Software
  • Distribute, sell, lease, or sublicense the Software
  • Use the Software for any unlawful purpose
  • Remove or alter any proprietary notices or labels
  • Attempt to bypass license verification or security measures
  • Share your license key or premium account with others
  • Use automation tools to interact with the Software

4. System Requirements and Compatibility

The Software requires the following minimum specifications to function correctly:

  • Minimum Requirements: Windows 10 (Build 19041) or Windows 11, 4 GB RAM (8 GB recommended), 500 MB free disk space, internet connection for licence verification and updates, and Administrator privileges
  • Unsupported Configurations: Virtual machines (VMware, VirtualBox, Hyper-V), Windows 10 LTSC/Enterprise IoT editions, heavily modified or customised Windows installations, and systems with conflicting third-party optimisation tools already installed
  • Compatibility Warnings: Some features may conflict with antivirus software. Corporate/managed Windows installations may restrict functionality. RGB software, hardware monitors, and overlays may conflict with Game Booster. Use on unsupported configurations is at your own risk
  • Hardware Warranty Disclaimer: Overclocking, aggressive power settings, and performance optimisations may void hardware warranties. Check with your device manufacturer before use

5. Intellectual Property

The Software and all related intellectual property rights are owned by AckerTech Studio. This agreement does not transfer any ownership rights to you.

6. Premium Features

Certain features require a premium subscription. Premium benefits include:

  • Access to all optimization tweaks and power settings
  • Game Booster with automatic game detection and process management
  • Deep Cleaner with comprehensive system scanning
  • Priority support and early access to new features
  • Custom tweak packs and advanced debloating tools
  • Cloud sync for preferences across devices
  • Up to 3 active device activations per license. You may deactivate a device at any time via Settings > License > Deactivate This Device to free an activation slot. Deactivation does not delete your license key — it simply frees the slot so you can activate on another device. The deactivated device will be switched to the free plan

7. Subscription and Payment Terms

This section governs all subscription purchases and refund rights.

  • Billing and Renewal: Monthly subscriptions automatically renew on the same date each month unless cancelled at least 24 hours before renewal. You may cancel at any time in your account settings.
  • Cancellation: Upon cancellation, your premium access continues until the end of your current paid billing period. You will not be charged for the next cycle. No partial refunds are issued for unused time in the current period.
  • Money-Back Guarantee: We offer a 7-day money-back guarantee from the date of your first subscription payment, no questions asked. Contact admin@ackertech.net within 7 days for a full refund.
  • Refunds for Major Failures (Australian Consumer Law): After the guarantee period, you are entitled to a refund if the Software has a major failure (crashes, corrupts data, does not work at all), does not match our description on the website, or is not fit for the purpose you told us about. Pro-rated refunds apply based on unused time.
  • Refund Exclusions (Where Legally Permitted): We may decline refunds for issues caused by user error or misconfiguration, incompatibility with unsupported system configurations listed in System Requirements, minor bugs that can be resolved through updates, or change of mind after the guarantee period (you can cancel future billing instead).
  • How to Request a Refund: Email admin@ackertech.net with your order number or email address, reason for refund, and a description of any technical issues. We aim to respond within 48 hours. Refunds are processed within 5–10 business days to your original payment method.
  • Australian Consumer Law Notice: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. 8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ACKERTECH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING IN THIS AGREEMENT EXCLUDES, RESTRICTS OR MODIFIES ANY CONSUMER GUARANTEE, RIGHT OR REMEDY CONFERRED BY THE AUSTRALIAN CONSUMER LAW THAT CANNOT BE EXCLUDED, RESTRICTED OR MODIFIED BY AGREEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACKERTECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO HARDWARE DAMAGE, OVERHEATING, BATTERY DEGRADATION, DATA LOSS, OR SYSTEM FAILURE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ACKERTECH’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO ACKERTECH IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR AUD $50, WHICHEVER IS GREATER. NOTHING IN THIS SECTION LIMITS LIABILITY FOR FRAUD, WILFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER AUSTRALIAN CONSUMER LAW.

10. System Modifications

The Software modifies Windows settings, registry values, power configurations, and system services. You acknowledge that:

  • You use the Software entirely at your own risk and discretion
  • Creating a System Restore Point is MANDATORY before applying major optimizations — the app will enforce this
  • Aggressive power plans may increase system temperatures — AckerTech is not responsible for hardware throttling or overheating
  • All optimizations are designed to be reversible via the app’s toggle system, but rely on your Windows installation’s integrity
  • AckerTech is not responsible for any hardware damage, system issues, or data loss that may arise
  • Some optimizations may affect Windows functionality (clearly labeled with warnings)
  • DATA BACKUP REQUIREMENT: YOU ARE SOLELY RESPONSIBLE FOR BACKING UP YOUR DATA BEFORE USING THE SOFTWARE. While the Software includes a mandatory restore point feature, we strongly recommend creating a full system image backup before first use, backing up important files to external storage, and testing that backups can be restored successfully. AckerTech is not a backup solution and cannot recover data if something goes wrong.

11. Updates and Modifications

The Software may automatically download and install updates without notice.

  • Updates may add, modify, or remove features, change system requirements, alter subscription pricing for new users (existing users are grandfathered), and include security patches and bug fixes
  • We reserve the right to modify or discontinue any aspect of the Software at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation
  • Updates may break compatibility with older Windows versions or configurations. We are not responsible for issues arising from Windows updates or system changes outside our control
  • If you purchased a lifetime licence, we will not remove features you paid for, but we may deprecate them if no longer technically feasible

12. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this agreement. Upon termination, you must uninstall and destroy all copies of the Software.

13. Account Management and Data

Some features require creating an account. You are responsible for maintaining the confidentiality of your credentials, all activity under your account, and notifying us immediately of any unauthorised access.

  • Data Access and Portability: You may request a copy of all personal data we hold about you at any time through Settings > Privacy > Request My Data. We will provide your data in JSON format (machine-readable) as an instant download. Data exports include all personal information, license records, coin transaction history, usage statistics, feedback submissions, and preferences. You may request a new export once every 10 minutes.
  • Device Management: You may deactivate your device at any time via Settings > License > Deactivate This Device. Deactivation does not delete or revoke your license key — it frees one activation slot, allowing you to activate on a different device. The deactivated device will be switched to the free plan immediately. Your cloud data is retained after deactivation and you can reactivate on the same device at any time if a slot is available.
  • Data Deletion: You may permanently delete all your cloud data at any time through Settings > Privacy > Delete My Data. Deletion removes all account records, progression data, coin transaction history, feedback submissions, and preferences. This action is irreversible and requires two confirmation steps. Your license key is not affected by data deletion. After deletion, the app will operate in local-only mode until you re-sync.
  • Account Suspension/Termination Rights: We reserve the right to suspend or terminate accounts for violation of these terms, fraudulent activity or payment disputes, licence key sharing or resale, abusive behaviour toward support staff, or extended periods of inactivity (12+ months).
  • Data Upon Termination: If your account is terminated, your access to premium features ends immediately, cloud-synced data will be deleted after 30 days, local data on your device remains but the app may not function fully, and no refund will be issued for remaining subscription time if terminated for cause.

14. Dispute Resolution

Before initiating any legal action, you agree to first contact us at admin@ackertech.net to attempt good-faith resolution.

  • Any dispute arising from these terms or use of the Software shall be resolved through binding arbitration in Queensland, Australia, rather than in court, except that you may assert claims in small claims court if they qualify
  • You agree to resolve disputes with AckerTech on an individual basis only, and waive any right to participate in class action lawsuits or class-wide arbitration
  • Nothing in this section affects your rights under Australian Consumer Law
  • Each party bears their own legal costs unless otherwise determined by the arbitrator

15. Indemnification

You agree to indemnify, defend, and hold harmless AckerTech, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: your use or misuse of the Software, your violation of these Terms of Service, your violation of any third-party rights, any damage caused by modifications you make to system files, or any content you submit or share through the Software. This indemnification survives termination of these terms.

16. Force Majeure

AckerTech is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including: acts of God (natural disasters, pandemics), internet service provider failures, cloud hosting provider outages (Supabase, Cloudflare, etc.), cyberattacks, DDoS, or hacking attempts, government actions or regulatory changes, labour strikes or disputes, and power failures or telecommunications failures. During such events, our obligations under these terms are suspended for the duration of the event.

17. Changes to Terms

AckerTech reserves the right to modify these terms at any time. Continued use of the Software after changes constitutes acceptance of the new terms. Significant changes will be communicated via in-app notification.

18. Governing Law

This agreement is governed by the laws of Queensland, Australia. Nothing in this agreement excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted or modified by agreement.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.

20. Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional terms presented at the time of purchase, constitute the entire agreement between you and AckerTech regarding the Software. These terms supersede all prior agreements, communications, and understandings, whether written or oral. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
