Terms of Service

1. Acceptance of Terms

By downloading, installing, or using AckerTech Optimizer ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License Grant

AckerTech Studio grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for personal, non-commercial use only, subject to these terms.

  • Free version: Single device only
  • Premium (Monthly/Annual): Up to 3 active devices simultaneously. Devices can be deactivated and reactivated through your account. Access continues for the purchased subscription period only
  • Lifetime: Up to 3 active devices simultaneously. The license is permanent and does not expire. Devices can be deactivated and reactivated through your account. Includes a 4x XP multiplier and all current and future premium features, subject to Section 11
  • Commercial use requires a separate business licence. Contact admin@ackertech.net for enquiries
  • Free features are perpetual. Premium subscriptions are valid for the purchased period only

3. Restrictions

You agree not to:

  • Reverse engineer, decompile, or disassemble the Software
  • Modify, adapt, or create derivative works based on the Software
  • Distribute, sell, lease, or sublicense the Software
  • Use the Software for any unlawful purpose
  • Remove or alter any proprietary notices or labels
  • Attempt to bypass license verification or security measures
  • Use automation tools to interact with the Software

4. Anti-Tampering Protection

AckerTech includes anti-tampering protection that automatically terminates the application if it detects the presence of decompilation tools (such as dnspy, ilspy, ghidra, ida), network analyzers (wireshark, fiddler, proxyman), memory editors (cheatengine), debuggers, or virtual machine environments. No warning is displayed. Users running such tools alongside AckerTech agree to this automatic termination as a condition of use. AckerTech requires execution in a native, non-virtualized Windows environment on authentic hardware.

5. System Requirements and Compatibility

The Software requires the following minimum specifications to function correctly:

  • Minimum Requirements: Windows 10 (Build 19041) or Windows 11, 4 GB RAM (8 GB recommended), 500 MB free disk space, internet connection for licence verification and updates, and Administrator privileges
  • Unsupported Configurations: Virtual machines (VMware, VirtualBox, Hyper-V), Windows 10 LTSC/Enterprise IoT editions, heavily modified or customised Windows installations, and systems with conflicting third-party optimisation tools already installed
  • Compatibility Warnings: Some features may conflict with antivirus software. Corporate/managed Windows installations may restrict functionality. RGB software, hardware monitors, and overlays may conflict with Game Booster. Use on unsupported configurations is at your own risk
  • Hardware Warranty Disclaimer: Overclocking, aggressive power settings, and performance optimisations may void hardware warranties. Check with your device manufacturer before use

6. Intellectual Property

The Software and all related intellectual property rights are owned by AckerTech Studio. This agreement does not transfer any ownership rights to you.

7. Premium Features

Certain features require a premium subscription. Premium benefits include:

  • Access to all optimizations (320+ system tweaks and power settings)
  • Game Booster with 1,000+ game detections and automatic process management
  • Full System Health access
  • Full Deep Cleaner access
  • 2x XP Multiplier (4x XP Multiplier for Lifetime)
  • Up to 3 device activations
  • Priority support

8. Subscription and Payment Terms

This section governs all subscription purchases and refund rights.

  • Billing and Renewal: Monthly subscriptions automatically renew on the same date each month unless cancelled at least 24 hours before renewal. You may cancel at any time in your account settings
  • Cancellation: Upon cancellation, your premium access continues until the end of your current paid billing period. You will not be charged for the next cycle. No partial refunds are issued for unused time in the current period
  • Money-Back Guarantee: We offer a 7-day money-back guarantee from the date of your first subscription payment, no questions asked. Contact admin@ackertech.net within 7 days for a full refund
  • Refunds for Major Failures (Australian Consumer Law): After the guarantee period, you are entitled to a refund if the Software has a major failure (crashes, corrupts data, does not work at all), does not match our description on the website, or is not fit for the purpose you told us about. Pro-rated refunds apply based on unused time
  • Refund Exclusions (Where Legally Permitted): We may decline refunds for issues caused by user error or misconfiguration, incompatibility with unsupported system configurations listed in System Requirements, minor bugs that can be resolved through updates, or change of mind after the guarantee period (you can cancel future billing instead)
  • How to Request a Refund: Email admin@ackertech.net with your order number or email address, reason for refund, and a description of any technical issues. We aim to respond within 48 hours. Refunds are processed within 5–10 business days to your original payment method
  • Australian Consumer Law Notice: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. 9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ACKERTECH STUDIO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING IN THIS AGREEMENT EXCLUDES, RESTRICTS OR MODIFIES ANY CONSUMER GUARANTEE, RIGHT OR REMEDY CONFERRED BY THE AUSTRALIAN CONSUMER LAW THAT CANNOT BE EXCLUDED, RESTRICTED OR MODIFIED BY AGREEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACKERTECH STUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO HARDWARE DAMAGE, OVERHEATING, BATTERY DEGRADATION, DATA LOSS, OR SYSTEM FAILURE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ACKERTECH STUDIO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SOFTWARE EXCEED THE GREATER OF FIFTY AUSTRALIAN DOLLARS (AUD $50.00) OR THE TOTAL AMOUNT YOU PAID TO ACKERTECH STUDIO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE INITIAL CLAIM. THIS LIMITATION DOES NOT EXCLUDE OR LIMIT LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER AUSTRALIAN CONSUMER LAW.

11. System Modifications

The Software modifies Windows settings, registry values, power configurations, and system services. You acknowledge that:

  • You use the Software entirely at your own risk and discretion
  • Creating a System Restore Point is MANDATORY before applying major optimizations. The app will prompt you to do this before any major change.
  • Aggressive power plans may increase system temperatures. AckerTech Studio is not responsible for hardware throttling or overheating
  • All optimizations are designed to be reversible via the app's toggle system, but rely on your Windows installation's integrity
  • AckerTech Studio is not responsible for any hardware damage, system issues, or data loss that may arise
  • Some optimizations may affect Windows functionality (clearly labeled with warnings)
  • AckerTech Optimizer is not a backup solution and cannot recover data if something goes wrong

12. Updates and Modifications

The Software may automatically download and install updates without notice.

  • Updates may add, modify, or remove features, change system requirements, alter subscription pricing for new users (existing users are grandfathered), and include security patches and bug fixes
  • We reserve the right to modify or discontinue any aspect of the Software at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation
  • Updates may break compatibility with older Windows versions or configurations. We are not responsible for issues arising from Windows updates or system changes outside our control
  • If you purchased a lifetime licence, we will not remove features you paid for, but we may deprecate them if no longer technically feasible

13. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this agreement. Upon termination, you must uninstall and destroy all copies of the Software.

14. Account Management and Data

Some features require creating an account. You are responsible for maintaining the confidentiality of your credentials, all activity under your account, and notifying us immediately of any unauthorised access.

  • Account Suspension/Termination Rights: We reserve the right to suspend or terminate accounts for violation of these terms, fraudulent activity or payment disputes, licence key sharing or resale, abusive behaviour toward support staff, or extended periods of inactivity (12+ months). Lifetime licence holders are exempt from inactivity-based termination and will not have their accounts terminated solely due to inactivity
  • Data Upon Termination: If your account is terminated, your access to premium features ends immediately, cloud-synced data will be deleted after 30 days, local data on your device remains but the app may not function fully, and no refund will be issued for remaining subscription time if terminated for cause

15. Dispute Resolution

Before initiating any legal action, you agree to first contact us at admin@ackertech.net to attempt good-faith resolution.

  • Any dispute arising from these terms or use of the Software shall be resolved through binding arbitration in Queensland, Australia, rather than in court, except that you may assert claims in small claims court if they qualify. This arbitration clause applies only to the extent permitted by applicable law in your jurisdiction. Users located in the EU, UK, or other jurisdictions with mandatory consumer dispute resolution rights are not required to waive those rights
  • You agree to resolve disputes with AckerTech Studio on an individual basis only, and waive any right to participate in class action lawsuits or class-wide arbitration, where permitted by applicable local law
  • Nothing in this section affects your rights under Australian Consumer Law
  • Each party bears their own legal costs unless otherwise determined by the arbitrator

16. Indemnification

You agree to indemnify, defend, and hold harmless AckerTech Studio, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your use of the Software in violation of any applicable law, or your violation of any third-party rights. This indemnification obligation does not apply to the extent a claim arises from our own negligence or misconduct.

17. Force Majeure

AckerTech Studio is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, internet or infrastructure outages, cyberattacks, or other causes outside our control. We will make reasonable efforts to resume normal operations as soon as practicable.

18. Changes to Terms

AckerTech Studio reserves the right to modify these terms at any time. For material changes, we will provide at least 30 days notice via email to the address associated with your account, or via a prominent in-app notification. Your continued use of the Software after the effective date of any changes constitutes acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the Software before the effective date.

19. Governing Law

This agreement is governed by the laws of Queensland, Australia. Nothing in this agreement excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted or modified by agreement.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AckerTech Studio regarding the Software and supersede all prior agreements, representations, or understandings between the parties relating to the same subject matter.

22. Feedback and Submissions

Any feedback, suggestions, ideas, or bug reports you submit to AckerTech Studio through the app, email, Discord, or any other channel ("Submissions") are non-confidential and become the property of AckerTech Studio. By submitting feedback, you grant AckerTech Studio a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, and incorporate your Submissions into the Software or related services without compensation to you, except where we choose to reward helpful contributions at our sole discretion.

23. Intellectual Property Infringement

AckerTech Studio respects the intellectual property rights of others. If you believe your intellectual property rights have been infringed, please submit a written notice to admin@ackertech.net including all of the following:

  • A description of the copyrighted work or intellectual property you claim has been infringed
  • Identification of the material you believe is infringing and its location
  • Your contact information (name, email address, and postal address)
  • A statement that you have a good-faith belief that the use is not authorised by the rights owner, its agent, or the law
  • A statement under penalty of perjury that the information in your notice is accurate and that you are the rights owner or authorised to act on their behalf

AckerTech Studio will investigate legitimate claims and take appropriate action, which may include removing or disabling access to the allegedly infringing content.

24. Age Restrictions

AckerTech Optimizer is not intended for use by children under the age of 13, or under 16 in the European Economic Area (EEA). We do not knowingly collect personal data from children below these ages. Because we only collect a hashed device identifier and not your name or age, we have no way to determine a user's age. If you are a parent or guardian and your child has used the Software, you can delete all associated data via Settings > Privacy > Delete My Data on the device in question.

25. Privacy and Data Collection

Your use of the Software is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what data we collect, how we use it, and your rights. Key points:

  • We do not collect behavioral telemetry, usage analytics, or automatic error reports. No data about which features you click, navigate to, or interact with is sent to our servers. All system diagnostics are processed locally on your machine
  • We do collect aggregate usage statistics that power in-app features, including: total optimizations applied, total disk space freed, total time spent in the app, total apps uninstalled, and counts of health tests, deep cleans, registry checks, and security checks. These figures are used solely for your gamification dashboard (XP, level, quests) and are never shared with third parties or used for advertising
  • Device identifiers are cryptographically hashed using SHA-256 before storage. Raw hardware information cannot be recovered from our database even in the event of a breach
  • IP addresses are stored only for security purposes (rate limiting and fraud prevention) and are not linked to your usage history or shared with third parties
  • You may request a copy of your data or request permanent deletion at any time via Settings > Privacy in the app
  • If you are located in the EEA or UK, you have additional rights under GDPR/UK GDPR including the right to data portability, erasure, restriction of processing, and to lodge complaints with your local supervisory authority. Data transfers from the EEA/UK to our infrastructure providers (Supabase, Cloudflare, LemonSqueezy) are conducted under Standard Contractual Clauses or applicable adequacy decisions.   • Our infrastructure is hosted on Supabase and Cloudflare. Payments are processed by LemonSqueezy. We never store your payment card details
